1. Acceptance of Terms

By accessing or using ASK.ME’s website or services (“Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not use the Platform. These Terms form a legal agreement between you (“User”) and The Arzola Group, Inc. (“we,” “us,” or “our”).

3. User Accounts

  • Eligibility: Users must be at least 13 years old. Users under 18 require parental consent.
  • Account Creation: Certain services may require account registration. You are responsible for safeguarding your account credentials.
  • Guest Access: Users can access the Platform without creating an account but may have limited features.
  • Account Suspension: ASK.ME reserves the right to suspend or terminate accounts for violations of these Terms.

4. Payment and Refund Policy

  • Payment Terms: Payment is required to submit questions or access services. Payments are non-refundable unless specified.
  • Refund Policy:
    • Refunds must be requested within 1 hour of purchase.
    • Partial refunds may be issued for unsatisfactory service based on arbitration decisions.
    • Refund requests require proof of non-delivery or service issues.
  • Subscriptions:
    • Subscription services will auto-renew unless canceled by the user at least 24 hours before the renewal date.
    • Cancellations must be processed through the user's account settings or by contacting ASK.ME support.
    • Users will have access to services until the end of the billing period after cancellation.
  • Payment Methods:
    • ASK.ME accepts major credit cards, debit cards, and payment platforms such as PayPal and Stripe.
    • Users must ensure payment information is accurate and up to date to avoid service interruptions.
  • Failed Transactions:
    • Users are responsible for ensuring valid payment methods.
    • ASK.ME reserves the right to charge a processing fee for failed transactions due to insufficient funds, expired cards, or other user errors.

5. User Responsibilities and Conduct

Users agree to:

  • Provide accurate and complete information.
  • Comply with all applicable laws and these Terms.
  • Use the Platform responsibly and respectfully.

Users must not:

  • Submit false or misleading information.
  • Harass or abuse ASK.ME’s team, partners, or vendors.
  • Disrupt the functionality of the Platform.
  • Engage in any illegal activities or violate intellectual property rights.

6. Prohibited Activities

Users are prohibited from:

  • Using bots, automated systems, or scraping tools.
  • Engaging in intellectual property theft or data misuse.
  • Circumventing payment processes.
  • Sharing illegal, offensive, or harmful content.
  • Spamming or promoting unrelated services.
  • Accessing or attempting to access unauthorized areas of the Platform.
  • Using the Platform to engage in fraudulent activities.
  • Attempting to breach data security measures or engaging in activities that compromise the privacy or security of the Platform.

ASK.ME reserves the right to suspend or terminate access for violations.


7. Ownership of Content

  • ASK.ME Content: All answers, insights, and materials provided remain the intellectual property of ASK.ME.
  • User Content: Users grant ASK.ME a perpetual, non-exclusive license to use anonymized questions and insights for research and marketing purposes.
  • Confidentiality: The Platform does not guarantee confidentiality for user-submitted content.
  • Third-Party Content: Users must not infringe on the intellectual property rights of third parties when using the Platform.

8. Privacy and Third-Party Services

ASK.ME uses trusted third-party services, such as:

  • Kajabi for data storage and platform management.
  • Stripe and PayPal for payment processing.

9. Intellectual Property

ASK.ME retains all rights to its proprietary tools, branding, content, and domain names, including ASK.ME, SHOW.ME, TELL.ME, BRING.ME, and SEND.ME. Users must not duplicate, redistribute, or misuse any intellectual property without written permission.


10. Membership & Subscription Management

  • Membership Terms: Memberships include specific benefits outlined on the Platform.
  • Auto-Renewal: Memberships may automatically renew unless canceled by the user at least 24 hours before the renewal date.
  • Cancellation: Users can cancel memberships through their account settings or by contacting ASK.ME support.

11. Feedback and Suggestions

By providing feedback, suggestions, or ideas to ASK.ME, you grant us the right to use them for any purpose, including improvements to the Platform. You agree that ASK.ME owes no compensation for submitted feedback.


12. Copyright Infringement Policy

If you believe your copyright-protected work has been infringed upon, please contact ASK.ME with the following:

  • A description of the copyrighted work.
  • A description of where the infringing material is located on the Platform.
  • Your contact information.

ASK.ME will review and act on valid claims in accordance with applicable copyright laws.


13. Fair Use Policy

ASK.ME services are intended for personal use. Excessive or abusive use that impacts the Platform’s availability for others may result in suspension or termination.


14. Third-Party Links and Content Disclaimer

ASK.ME may provide links to third-party websites or resources. ASK.ME is not responsible for the content, services, or goods provided by third parties and disclaims liability for any damages arising from their use. Users access third-party links at their own risk.


15. Emergency Situations Disclaimer

ASK.ME is not suitable for emergency situations. Users facing emergencies (e.g., medical, legal, or mental health crises) should contact appropriate professionals or emergency services.


16. Expert Verification and Limitations

ASK.ME verifies the credentials of experts to the best of its ability but does not guarantee their qualifications, expertise, or accuracy of information provided. Users are encouraged to exercise discretion when acting on advice received.


17. SMS and Communication Terms

By registering for ASK.ME, users consent to receive communications, including calls and text messages. Users can opt out of promotional messages but may still receive transactional alerts related to their account or services.


18. Disclaimers and Limitations of Liability

ASK.ME provides answers and services for informational purposes only. By using the Platform, you agree to the following:

  • Accuracy and Reliance: While ASK.ME strives to provide accurate and up-to-date information, it does not guarantee the reliability, completeness, or accuracy of responses. Users are responsible for evaluating the information provided and acting upon it at their discretion.

  • Limitations of Liability:

    • ASK.ME, its affiliates, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform or services. This includes, but is not limited to, damages for lost profits, lost data, or business interruption.
    • The total liability of ASK.ME, for any claim arising out of or relating to the use of the Platform, shall not exceed the amount paid by the user for the service in question.
  • No Guarantees: ASK.ME does not guarantee specific outcomes or results from the use of its services.


19. Earnings Disclaimer

ASK.ME does not guarantee financial success or specific results from using its services. Individual results depend on many factors, including effort, experience, and resources.


20. Arbitration and Dispute Resolution

  • Arbitration Clause: Any disputes arising out of or relating to these Terms or the Platform shall be resolved exclusively through binding arbitration in accordance with the rules of the American Arbitration Association (AAA).
  • Class Action Waiver: Users waive the right to participate in class action lawsuits.
  • Opt-Out Option: Users may opt out of arbitration within 30 days of agreeing to these Terms by notifying ASK.ME in writing.
  • Costs: Arbitration costs will be shared unless otherwise determined by the arbitrator.

21. Termination of Services

ASK.ME reserves the right to terminate or suspend user access to the Platform at any time for violations of these Terms or for any reason deemed necessary.

  • User-Initiated Termination: Users may terminate their accounts by contacting ASK.ME in writing.
  • Obligations Upon Termination: Termination does not absolve users of payment obligations. Users remain responsible for all transactions processed prior to termination.

22. Force Majeure

ASK.ME shall not be held liable for delays or failure in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, government actions, labor disputes, technical failures, or pandemics.


23. User-Generated Content Policy

Users may submit content, including but not limited to questions, comments, and feedback. By submitting content, users agree that:

  • They hold all necessary rights to the content submitted.
  • The content does not violate the rights of any third party, including intellectual property, privacy, or publicity rights.
  • ASK.ME reserves the right to remove or edit content that violates these Terms or is deemed inappropriate.

24. Modification of Services

ASK.ME reserves the right to modify, suspend, or discontinue any part of its services at any time without prior notice. In the event of significant changes that impact users, ASK.ME will attempt to provide reasonable notice through email or updates on the Platform.


25. Data Retention and Security

ASK.ME is committed to protecting user data and employs appropriate measures to secure personal information. Users agree to:

  • Ensure their account information is accurate and up-to-date.
  • Notify ASK.ME immediately in the event of unauthorized access to their accounts.

ASK.ME retains user data for as long as necessary to provide services or as required by applicable laws. Users acknowledge and accept these limitations.


26. Trial Periods and Promotions

ASK.ME may offer promotional discounts or free trial periods for services. By enrolling in such promotions, users agree to the following:

  • Trial periods may automatically convert to paid subscriptions unless canceled before the trial ends.
  • ASK.ME reserves the right to modify or terminate promotions at its discretion.

27. User Indemnification

Users agree to indemnify, defend, and hold harmless ASK.ME, its affiliates, officers, employees, and partners from any claims, liabilities, damages, losses, or expenses (including attorney fees) arising out of or related to:

  • User’s violation of these Terms.
  • User’s use of the Platform.
  • Any content submitted by the User that infringes the rights of third parties, including intellectual property, privacy, or publicity rights.
  • User’s interactions or transactions with other users or third parties through the Platform.

ASK.ME reserves the right to assume exclusive defense and control of any matter subject to indemnification, and users agree to cooperate fully with such defense.


28. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Miami-Dade County, Florida.


29. Modifications to Terms

ASK.ME reserves the right to modify these Terms at any time. Users will be notified of significant changes through email or updates on the Platform. Continued use of the Platform after modifications constitutes acceptance of the updated Terms.
